Casey Anthony Unsealed Motion To Determine Competency To Stand Trial
This Motion To Determine Competency To Proceed was unsealed for court record on June 27, 2011.
On Saturday June 25, the defense filed this motion that Casey be examined by three psychologist to determine her competency to proceed in her trial. After a sidebar during re-direct of her mother, Cindy Anthony, Casey appeared visibly agitated and displayed erratic emotion. It has been reported that Casey Anthony made a statement to defense attorneys that caused them to file the motion to determine her competency to proceed with the trial. Other experts and opinions have viewed this as a stall tactic on the defense's behalf.
Legal analyst Bill Sheaffer said the defense could be trying to prevent Casey from testifying.
"It may well be that Casey Anthony believes that she should take the witness stand against her lawyers' advice," Sheaffer said.
Sheaffer admits it wouldn't stop Casey from testifying if she insists on it, and that decision is hers and hers alone. But it would protect the defense later, if things go bad and she tries to blame her attorneys for putting her on the stand.
